Passenger Transportation and Service Agreement

1- Parties:

The service provider will be referred to as "Elegance Transfer."

The individual whose name is specified in the reservation and/or the persons represented by him/her will be referred to as "Consumer or Customer."

2- Subject:

This contract has been made between the consumer and Elegance Transfer. This contract has been prepared for the telephone or electronic sales of services specified on the Elegance Transfer website regarding the characteristics and sales conditions of the services, and it covers the rights and acquisitions of the parties.

With this contract, the parties have agreed within the framework of the following contract conditions on the provision of transfer service from and/or to airports from addresses or hotels determined by themselves before and after the flight, and the performance of this service by Elegance Transfer against payment.

3- Service and Payment Information:

The contract price is the amount specified in the reservation confirmation form.

In private transfer service, requests for different points other than the route specified in the reservation; if on the route and without waiting, included in the price, if not on the route, the amount determined by Elegance Transfer for each different point shall be paid by the passenger in the region.

Elegance Transfer reserves the right to change the vehicle in case of necessity without notifying the consumer and without any change in the fee. If the customer does not accept this change, he/she has the right to cancel the reservation and receive the full amount paid. In this case, the customer shall not have the right to claim compensation.

With this contract, the consumer will be deemed to have accepted to pay the service fee to Elegance Transfer upon completion of the work.

5- Payment Method:

Cash (Payment to the driver in the vehicle)

6- Number of Persons: The consumer must specify the number of persons.

7- General Provisions:

Passengers are required to wear seat belts for traffic laws and safety.

Even if the consumer cannot sign the contract for any reason by purchasing it with a bank or credit card, it is deemed that he/she has learned the contract terms that will be valid between the parties through the website or advertisements and accepts to receive the service under the written conditions in the contract.

Reservation can be canceled by the customer up to 6 hours before.

Except for allocation and tour services, the customer does not have the authority to change this route in transfer services. In this context, it is unacceptable for the passenger to stop at a different point between the specified routes or wait at this point. Elegance Transfer is obliged to transport the customer from only one point to the specified point, from the point to the airport, or from the airport to the specified point. Elegance Transfer is obliged to allocate a vehicle suitable for the number of passengers and baggage volume specified by the consumer at the time of purchase online. Elegance Transfer undertakes that all vehicles allocated to the service subject to this contract will have their insurances completed, their periodic maintenance completed, and materials such as compulsory spare tire, first aid kit, fire extinguisher, reflector inside the vehicle. In case of any traffic accident or other reason during the service, Elegance Transfer shall not be liable for any physical or material damage to the customer or the transported goods.

In the event of such a situation, the Customer accepts and declares in advance that there will be no liability of Elegance Transfer arising from Article 66 of the Turkish Code of Obligations and other provisions of the legislation. The provisions of this contract that impose liability on Elegance Transfer are reserved. Despite the allocation of the vehicle suitable for the transfer service, if the number of passengers and baggage volume determined at the time of purchase online is exceeded, the transfer will be carried out without exceeding the legal transportation limits of the vehicle. Passengers or baggage exceeding legal limits are not accepted on the vehicle. If the customer cancels the transfer service for this reason, no refund will be made. In addition, in this case, the customer cannot claim any right or receivable against Elegance Transfer under any name. In case of detection by the driver of materials such as bags, boxes, which may damage the vehicle as baggage during the service, Elegance Transfer has no responsibility to carry them. Each passenger is entitled to 20 kg of baggage per person. In case of any baggage loss or damage caused by Elegance Transfer, the service fee will be paid to the passenger as material and moral compensation for undeclared items previously taken from the passenger. The customer accepts, commits, and declares that there are no prohibited items under the laws of the Republic of Turkey to be carried and possessed in the baggage. If the presence of the items mentioned is noticed by the driver, the baggage in question will not be accepted inside the vehicle. In case the presence of the mentioned materials is noticed during the evacuation of the baggage, or if it is detected during the inspection and search by the law enforcement officers during the transfer, any damages and losses incurred by Elegance Transfer for this reason will be paid in cash and immediately by the customer. Requests for the transfer of pets and the type of pet to be transported will be notified by the customer during the online purchase of the service. Pet transportation will not be carried out without such notification. Pet transportation alone without an adult customer will not be carried out. The animal to be transferred under these conditions can be transported in a special cage, in a section determined by the Elegance Transfer personnel inside the vehicle, provided that all kinds of responsibility belong to the customer. The transportation of animals whose acquisition, possession, and transportation are illegal according to the Turkish laws is not possible under any circumstances. In transfers from a specific point to the airport, Elegance Transfer declares and undertakes that the vehicle allocated for Elegance Transfer will be at the specified point at the transfer time. A delay of 15 (fifteen) minutes from the transfer time will be considered a reasonable delay. In case of a delay exceeding 15 (fifteen) minutes, the customer is not obliged to wait for the vehicle. In this case, the transfer fee will be refunded to the customer. In points such as the site, collective housing, where the transfer will take place; If the delay time of 15 (fifteen) minutes is exceeded due to the prevention of the vehicle's entry by the site security officers, the responsibility lies with Elegance Transfer. Refunds are not made if the delay exceeds 15 (fifteen) minutes and the customer does not wait for the vehicle. The customer must be present with his/her luggage at the designated point at the transfer time. If the customer is not present at the transfer point at the transfer time, the vehicle allocated by Elegance Transfer is obliged to wait for the customer for 15 (fifteen) minutes. After 15 (fifteen) minutes, the vehicle is no longer obliged to wait for the customer with his/her luggage at the designated point. 8- Force Majeure

In case of any kind and nature of force majeure events that are not caused by the parties, natural events, adverse weather conditions, social events, public movements, adverse developments in working life, legal or illegal labor or employer movements, strikes, lockouts, union movements, and work slowdown actions, war, armed conflict, revolution, declaration of martial law or state of emergency, conflicts and riots between groups, if the obligations under this contract cannot be fulfilled due to events resulting from, until the end of the mentioned situations/negative effects, this contract will be suspended. The contract will come into effect again with the end of the mentioned situations/negative effects. Failure of the parties to fulfill their obligations due to force majeure does not grant the other party the right to terminate or claim compensation.

9- Jurisdiction

In the resolution of any disputes arising from the implementation of this contract, Turkish Laws will be applied, and Antalya Courts and Enforcement Offices will be authorized.

10- Effectiveness

Those passengers who did not sign the contract but received the service covered by the contract by appointing third parties who are responsible for registering in their own names, by reading and signing this contract, are deemed to have accepted the contract terms. This contract has been drawn up in 2 copies and signed by the parties, and in case of disputes arising from the contract, the provisions of the Turkish Road Transport Law No. 4925 and other relevant Turkish legislation shall apply. Antalya courts and enforcement offices are competent.
