PASSENGER TRANSPORT AND SERVICE AGREEMENT

1- Parties:

The service provider will be referred to as "Elegance transfer".

The person whose name is specified in the reservation, and/or the persons represented by him/her, will be referred to as the "Consumer or Customer".

2- Subject:

This agreement has been made between the consumer and Elegance Transfer. This contract has been prepared for the service sales made by Elegance Transfer via telephone or electronic means, specifying the characteristics and sales conditions of the services on the Elegance Transfer website, and covers the rights and acquisitions of the parties.

With this agreement, the parties have agreed within the framework of the following contract conditions regarding the provision of transfer service from/to addresses or hotels determined by themselves before and after the flight to airports and/or vice versa, and the performance of this service by Elegance Transfer for a fee.

3- Service and Payment Information

The contract price is the amount specified in the reservation confirmation form.

In private transfer service, requests for different points other than the route specified in the reservation; if on the route and without waiting, included in the price, if not on the route, the amount determined by Elegance Transfer for each different point is paid by the passenger in the region.

Elegance Transfer reserves the right to make changes to the transfer vehicle without informing the consumer if necessary, without any change in fees. If the customer does not accept this change, he/she has the right to cancel the reservation and receive a full refund of the fee paid. In this case, the customer has no right to compensation.

With this contract, the consumer will be deemed to have accepted to pay the service fee to Elegance Transfer upon completion of the service.

5- Payment Method:

Cash (Payment to the driver in the vehicle)

Bank (By bank transfer to company accounts)

6- Number of Persons: The consumer must specify the number of persons.

7- General Provisions

Passengers are required to fasten their seat belts for traffic laws and safety.

Even if the consumer has not signed this agreement for any reason by purchasing it with a bank or credit card, it is deemed that the consumer has learned the terms of the contract that will be valid between the parties through the website or advertisements and has accepted to receive the service under the terms written in the contract.

Reservation can be canceled by the customer up to 6 hours before.

Except for allocation and tour services, the customer does not have the authority to change this route in transfer services. In this context, requests for the passenger to stop at a different point between the specified routes and to wait for a while at that point are not accepted. Elegance Transfer is only responsible for transporting the customer from a single point to a designated point, from the point to the airport, or from the airport to a designated point. Elegance Transfer is obliged to allocate vehicles suitable for the number of passengers and baggage volume determined by the consumer at the time of online purchase for the service subject to this agreement. Elegance Transfer undertakes that all vehicles allocated for the service subject to this agreement will have complete insurance, will have undergone periodic maintenance, and will have mandatory equipment such as spare tire, first aid kit, fire extinguisher, reflector, etc. In case of any traffic accident or other reason during the service, Elegance Transfer shall not be liable for any bodily or material damage to the customer or damage to the transported goods.

In case of such damage, the customer acknowledges and declares in advance that Elegance Transfer will not have any liability arising from Article 66 of the Law of Obligations and other provisions of the legislation. The provisions of this agreement imposing liability on Elegance Transfer are reserved. Despite the allocation of a suitable vehicle for transport, if the number of passengers and baggage volume determined by the customer at the time of purchase is exceeded, the transfer will be carried out without exceeding the legal transport limits. Passengers or luggage exceeding legal limits will not be accepted. In case the customer cancels the transfer due to this reason, no refund will be made. In addition, in this case, the customer cannot claim any right or receivable against Elegance Transfer. If any health problem occurs during the transfer of passengers or animals carried inside the vehicle, the personnel of Elegance Transfer are obliged to transfer the passenger to the nearest health facility immediately. The contrary request of the passenger does not bind the personnel of Elegance Transfer. The nearest health facility may be official health institutions as well as private health institutions. Any bodily harm, material damage, or any other damage incurred during the transfer of the passenger/animal to the nearest health facility or afterwards is not the responsibility of Elegance Transfer. At the end of the transfer, the customer is obliged to sign the notification document stating that he/she has purchased the service and reached the destination.

8- Force Majeure

In case of any kind and nature of force majeure events not caused by the parties themselves, natural events, adverse weather conditions, social events, public movements, negative developments in labor life, legal or illegal actions of any kind by workers or employers, strikes, lockouts, union movements, and work slowdown actions, war, armed conflict, revolution, declaration of martial law or state of emergency, intergroup conflicts, and riots, if the parties are unable to fulfill their obligations under this agreement. This agreement will be suspended until the end of the mentioned circumstances/adverse effects. The contract will come into force again when the mentioned circumstances/adverse effects end. The inability of the parties to fulfill their obligations due to force majeure does not grant the other party the right to terminate or claim compensation.

9- Authority

In the resolution of any disputes arising from the implementation of this agreement, Turkish laws will apply, and the Antalya Courts and Enforcement Offices will have jurisdiction.

10- Effectiveness

Passengers who have not signed this contract but have received the service covered by the contract are deemed to have accepted the provisions of the contract by reading and signing it themselves or by the third parties they have appointed to register in their names. This agreement, prepared in two copies and signed by the parties, shall be governed by the provisions of the Law No. 4925 on Road Transport and other Turkish legislation in case of disputes arising from the contract. Antalya courts and enforcement offices have jurisdiction. I have received one copy of this contract, which has been prepared on our behalf, after reading, understanding, and accepting the information on the date and time of the journey, Law No. 4925 on Road Transport, and the information on the website.
